A RESOLUTION MAKING FINDINGS AS TO THE ADVISABILITY AND AUTHORIZING CONSTRUCTION OF AN IMPROVEMENT UNDER AND PURSUANT TO K.S.A. 12-6a01 et seq. AND REVISING A PREVIOUS RESOLUTION AUTHORIZING THE SAME IMPROVEMENT WHEREAS, a Petition was filed with the City Clerk on the 7th day of September, 2011, requesting water main improvements for the Bellerive Addition to the City of Manhattan, Riley County, Kansas, Project No. WA1113, and the Governing Body of the City found said Petition to be sufficient and in compliance with Kansas statute and other applicable laws, rules and regulations and found the improvements requested therein to be advisable in its Resolution No. 092011-C, which is filed at Book 847, Page 2486 of the records of the Riley County Register of Deeds; and WHEREAS, since the adoption of Resolution No. 092011-C, Lots 1A, 1B, 2A, 2B, 3A, 3B, 4A, 4B, 5A, 5B, 6A, 6B, 7A, 7B, 8A, 8B, 9A, 9B, 10 A, 10B, 11A, 11B, 12A, 12B, 13A and 13B of the Bellerive Addition have been replatted as Lots 1A through 13B, inclusive, the Bellerive Addition, Unit Two to the City of Manhattan, Riley County, Kansas, the boundary lines of Lots 8A and 8B of the Bellerive Addition, Unit Two have been corrected and replatted as Lots 1A and 1B ,the Bellerive Addition, Unit Three to the City of Manhattan, Riley County, Kansas and the un-platted tract referred to as Tract A and which constituted a portion of the improvement district described in Resolution No. 092011-C has been platted as Lots 2, 3, 5 and 6, inclusive, the Congressional Addition to the City of Manhattan, Riley County, Kansas, which is part of the addition described as Lots 1 through 22, inclusive, Congressional Addition, to the City of Manhattan, Riley County, Kansas; and WHEREAS, an Amended Petition that complies with the requirements of K.S.A. 12-6a01 et seq. was filed with the City Clerk on the 11th day of May, 2015 requesting that Resolution No. 092011-C be amended by rescinding and replacing the Proposed Improvement District, Estimated or Probable Cost and Method of Assessment set forth within Resolution No. 092011-C with the revised Proposed Improvement District, Estimated or Probable Cost and Method of Assessment set forth within this Resolution No. 051915-C without notice and hearing; and WHEREAS, the signers of the Amended Petition filed with the City Clerk on the 11th day of May, 2015 acknowledged and agreed that while all portions of the Congressional Addition benefited when and because the improvements authorized in Resolution No. 092011-C were made, the benefits to the property contained in the Congressional Addition were confined and otherwise limited to the ability to construct and attach water main infrastructure to the improvements authorized in Resolution No. 092011-C; and WHEREAS, the signers of the Amended Petition filed with the City Clerk on the 11th day of May, 2015 acknowledged and agreed that any special assessments levied against property within the Congressional Addition must reflect the confined and otherwise limited benefit received by such property and that the reapportionment of the special assessments for which Tract A would have been responsible pursuant to Resolution No. 092011-C against all lots in the Congressional Addition constitutes a reasonable assessment plan that reflects the special benefits accruing to each lot or parcel included within the proposed improvement district set forth within this Resolution No. 051915-C and imposes substantially equal burdens or shares of the cost of improvements requested by the Amended Petition upon similarly benefited property within said Proposed Improvement District; and WHEREAS, the signers of the Amended Petition filed with the City Clerk on the 11th day of May, 2015 petitioned for the proposed improvement district set forth in Resolution No. 092011-C to be expanded to include all of the Congressional Addition; and WHEREAS, the Governing Body of the City wishes to adopt this Resolution No. 051915-C to amend Resolution No. 092011-C by rescinding and replacing the Proposed Improvement District, Estimated or Probable Cost and Method of Assessment set forth within Resolution No. 092011-C with the revised Proposed Improvement District, Estimated or Probable Cost and Method of Assessment set forth within this Resolution No. 051915-C. NOW THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF MANHATTAN, KANSAS; that the following findings as to the advisability of the construction of said improvements are hereby made to-wit: a) The Amended Petition that complies with the requirements of K.S.A. 12-6a01 et seq. that was filed with the City Clerk on the 11th day of May, 2015 requesting that Resolution No. 092011-C be amended by rescinding and replacing the Proposed Improvement District, Estimated or Probable Cost and Method of Assessment set forth within Resolution No. 092011-C with the revised Proposed Improvement District, Estimated or Probable Cost and Method of Assessment set forth within this Resolution No. 051915-C is sufficient and in compliance with Kansas statute and other applicable laws, rules and regulations. The improvements, proposed improvement district, estimated or probable cost, method of assessment and apportionment of costs contained and requested in said Amended Petition and set forth below within this Resolution No. 051915-C are advisable and in compliance with Kansas statute and other applicable laws, rules and regulations. b) GENERAL NATURE OF THE IMPROVEMENT: WATER MAIN Construction of approximately 2,625 feet of 12 inch ductile iron pipe water main and related fittings, valves, and fire hydrants necessary to serve the Bellerive Addition to the City of Manhattan, Riley County, Kansas, the Bellerive Addition, Unit Two to the City of Manhattan, Riley County, Kansas, the Bellerive Addition, Unit Three to the City of Manhattan, Riley County, Kansas and provide water main access to the Congressional Addition to the City of Manhattan, Riley County, Kansas (collectively the "Improvements"). c) PROPOSED IMPROVEMENT DISTRICT (Public right-of-way excluded.): Lots 14 - 37, inclusive, Bellerive Addition to the City of Manhattan, Riley County, Kansas; Lots 1A - 7B and Lots 9A - 13B, inclusive, Bellerive Addition, Unit Two to the City of Manhattan, Riley County, Kansas; Lots 1A - 1B, inclusive, Bellerive Addition, Unit Three to the City of Manhattan, Riley County, Kansas; and Lots 1 - 22, inclusive, Congressional Addition, an Addition to the City of Manhattan, Riley County, Kansas (collectively the "Proposed Improvement District"). All reserve lots and public rights of way contained within the Proposed Improvement District shall not be assessed special assessments. d) ESTIMATED OR PROBABLE COST: ($357,000) Three Hundred and Fifty-Seven Thousand Dollars (no/cents). e) METHOD OF ASSESSMENT: The property contained within the Bellerive Addition to the City of Manhattan, Riley County, Kansas, the Bellerive Addition, Unit Two to the City of Manhattan, Riley County, Kansas, the Bellerive Addition, Unit Three to the City of Manhattan, Riley County, Kansas shall collectively be responsible for 92.6% of the cost of the improvements authorized herein which shall be spread and apportioned on an equal share per lot basis as follows (total of 50 shares): Lots 14 - 37, Bellerive Addition to the City of Manhattan, Riley County, Kansas (24 shares); and Lots 1A - 7B and Lots 9A - 13B, Bellerive Addition, Unit Two to the City of Manhattan, Riley County, Kansas (24 shares); and Lots 1A - 1B, Bellerive Addition, Unit Three to the City of Manhattan, Riley County, Kansas (2 shares). The property contained within the Congressional Addition to the City of Manhattan, Riley County, Kansas shall collectively be responsible for 7.4% of the cost of the improvements authorized herein which shall be spread and apportioned on an equal share per lot basis as follows (total of 22 shares): Lots 1 - 22 of Congressional Addition, an Addition to the City of Manhattan, Riley County, Kansas (22 shares). In the event all or part of the lots, parcels or tracts in the Proposed Improvement District are replatted before assessments have been levied, the assessments against the replatted area shall be calculated on the basis of the method of assessment set forth herein. Where the ownership of a single lot, parcel or tract is or may be divided into two or more lots, parcels or tracts, the assessment to the lot, parcel or tract so divided may be assessed to each ownership of said lot, parcel or tract, on a square foot basis, or as otherwise determined by the Governing Body, in its sole discretion. f) APPORTIONMENT OF COSTS: Proposed Improvement District 82.77% Eighty-two and 77/100 Percent City-At-Large: 17.23% Seventeen and 23/100 Percent BE IT FURTHER RESOLVED, that the City Engineer, or his authorized representative of the City of Manhattan, Kansas, be and is hereby appointed and directed to prepare under oath a detailed estimate of the cost of said improvement together with plans and specifications therefore, and file the same with the City Clerk for consideration and action thereon by the Governing Body of the City of Manhattan, Kansas. BE IT FURTHER RESOLVED, K.S.A. 12-6a01 et seq., provides for the abovesaid improvements to be paid by the issuance of general obligation bonds of the City (the "Bonds"). The Bonds may be issued to reimburse expenditures made on or after the date, which is 60 days before the date of Resolution No. 092011-C, pursuant to Treasury Regulation 1.150-2. BE IT FURTHER RESOLVED, that the above described improvement is hereby authorized and declared to be necessary in accordance with the findings of the Governing Body as set out in this resolution, and that this resolution shall take effect and be in force from and after its adoption and publication once in The Manhattan Mercury. BE IT FURTHER RESOLVED, that this resolution shall be filed with the Riley County Register of Deeds Office. BE IT FURTHER RESOLVED, that the benefit district portion of the cost of the above described improvement shall be bonded for twenty (20) years.
