    NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS Published in The Manhattan Mercury on April 27, 2017. City of Manhattan Community Development Department 1101 Poyntz Avenue Manhattan, KS 66502 (785) 587-2430 The City of Manhattan's Community Development Block Grant (CDBG) Program Year (PY) 2016 total allocation is $660,894. On or after May 9, 2017 the City of Manhattan will submit a request to HUD to undertake PY 2016 Project 5: Neighborhood Infrastructure with a total budget of $77,000 that will include construction of the Old Blue River Trail/Linear Trail Connection and Sidewalk Connection/ADA improvements. The Sidewalk Connection will begin on the east side of Hayes Drive, at the end of an existing 6-foot concrete path and proceed south to connect to an existing Trailhead for the City's 9-mile Linear Trail. A new pedestrian crosswalk will then lead to the Old Blue River Trail (OBRT) that will be constructed along an service road, built on the former east bank of the Old Blue River channel, and proceed approximately 3,020 LF west and south to the intersection of Goodfood Place and Limey Place. This project is "Categorically Excluded, Subject To" HUD regulations at 24 CFR Part 58 under National Environmental Policy Act requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project will be on file beginning on April 28, 2017 at the City of Manhattan Community Development Department, 1101 Poyntz Avenue, Manhattan KS 66502, where the ERR can be examined, or copied for a fee, weekdays 8 a.m. to 5 p.m. until May 8, 2017. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City of Manhattan Community Development Department at 1101 Poyntz Ave, Manhattan KS 66502. All comments received by May 8, 2017 at 5:00 p.m. will be considered by the City of Manhattan prior to authorizing submission of a request for release of funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the City of Manhattan's certification for a period of fifteen (15) days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Manhattan; (b) the City of Manhattan has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to the HUD Region VII Office at 400 State Ave, Kansas City, KS 66101-2406. Potential objectors should contact HUD to verify the actual last day of the objection period. RELEASE OF FUNDS The City of Manhattan certifies to HUD that Ron R. Fehr, in his capacity as City Manager, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Manhattan to use HUD program funds.
