    ORDINANCE NO. 7234 SUMMARY (PUBLISHED IN THE MANHATTAN MERCURY ON JULY 24, 2016) On July 19, 2016, the governing body of the City of Manhattan, Kansas passed an ordinance entitled: AN ORDINANCE APPROPRIATING AND LEVYING SPECIAL ASSESSMENTS TO PAY FOR THE COST OF CONSTRUCTING THE FOLLOWING IMPROVEMENT PROJECTS: DOWNTOWN ENTERTAINMENT DISTRICT, UNIT THREE LOT 5 - STREET (ST1212); NORTHLAKE ADDITION, UNIT 1 - SANITARY SEWER (SS1311), STREET (ST1314), AND WATER (WA1313); POYNTZ AVENUE IMPROVEMENTS - STREET (ST1203); AND THE RESERVE ADDITION - SANITARY SEWER (SS1210) AND WATER (WA1216). The Ordinance levies special assessments on certain property located in the city of Manhattan, Riley County, Kansas, which have been benefitted from certain internal improvements authorized pursuant to K.S.A. 12-6a01 et seq., and described in the above captioned Ordinance. Properties to be assessed are located in the Downtown Entertainment District, Unit Three Lot 5; Northlake Addition, Unit 1; Poyntz Avenue; and The Reserve Addition.     RESOLUTION NO. 071916-F Published in The Manhattan Mercury on Sunday, July 24, 2016. A RESOLUTION MAKING FINDINGS AS TO THE ADVISABILITY AND AUTHORIZING CONSTRUCTION OF AN IMPROVEMENT UNDER AND PURSUANT TO K.S.A. 12-6a01, et seq. WHEREAS, a petition was filed with the City Clerk on the 24th day of June, 2016, requesting water improvements for Lots 1 through 2 of Ledge Stone Addition and Lots 1 through 2 of Ledgestone Ridge, Unit One, Project No. ST1615 and the Governing Body of the City hereby find the petition to be sufficient. NOW THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF MANHATTAN, KANSAS; that the following findings as to the advisability of the construction of said improvements are hereby made to-wit: a) GENERAL NATURE OF IMPROVEMENT: STREET The construction of 31-foot wide (back of curb to back of curb) Ledge Stone Drive (6-inch concrete on 4" of base rock) with monolithic concrete curb including excavation, embankment, compaction and utility sleeve installations. Engineering design, inspection, administration and interest on temporar y notes are also included. b) PROPOSED IMPROVEMENT DISTRICT (Public right-of-way excluded.): Lots 1 through 2 of Ledge Stone Addition and Lots 1 through 2 of Ledgestone Ridge, Unit One, an addition to the City of Manhattan, Riley County, Kansas. The boundaries of the Improvement District cannot be modified after this Petition has been accepted by the City; however, in the event tracts or lots within the boundaries of the Improvement District are altered, prior to the adoption of any ordinance levying assessments in accordance with this petition, by a replat, lot split or boundary line adjustment accepted by the City, the legal description of the Improvement District shall be automatically adjusted to be consistent with such action and the levying ordinance shall be applied to such adjusted description. However, the acceptance of this Petition does not require the city to approve any such requested replat, lot split or boundary line adjustment. c) ESTIMATED OR PROBABLE COST: ($248,252.00) Two Hundred Forty-Eight Thousand Two Hundred Fity-Two and 00/100 Dollars. d) METHOD OF ASSESSMENT: Per Lot Basis Lots 1 through 2 of Ledge Stone Addition @ 1 share each Lots 1 through 2 of Ledgestone Ridge, Unit One @ 1 share each 4 Total Shares In the event all or part of the lots in the Improvement District are altered by replat, boundary line adjustment or lot split accepted by the City and before assessments have been levied, the assessments against the Improvement District, as modified by such action, shall be applied on an equal share per lot, as those lots exist after such action. In the event a lot or lots within the Improvement District are altered by replat, boundary line adjustment or lot split accepted by the city after assessments have been levied by ordinance, the assessment applicable to the lot(s) so altered shall be apportioned to the new lot(s) based upon the relative square footage of those new lots. However, the acceptance of this petition does not require the City to approve any such requested replat, boundary line adjustment or lot split. e) APPORTIONMENT OF COSTS: Improvement District: 100% One Hundred Percent City-At-Large: 0% Zero Percent BE IT FURTHER RESOLVED, that the City Engineer or his authorized representative of the City of Manhattan, Kansas, be and is hereby appointed and directed to prepare under oath a detailed estimate of the cost of said improvement together with plans and specifications therefore, and file the same with the City Clerk for consideration and action thereon by the Governing Body of the City of Manhattan, Kansas. BE IT FURTHER RESOLVED, that the Improvement District is subject to the City's Policy (the "Policy"), as set forth in Resolution No. 010516-C, which establishes certain conditions for the acceptance of petitions for the creation of improvement districts pursuant to K.S.A. 12-6a01, et. seq. and for the subsequent modification of lots or tracts within a previously created improvement district. BE IT FURTHER RESOLVED, 12-6a01, et seq. provides for the abovesaid improvements to be paid by the issuance of general obligation bonds of the City (the "Bonds"). The Bonds may be issued to reimburse expenditures made on or after the date, which is 60 days before the date of this resolution, pursuant to Treasury Regulation 1.150-2. BE IT FURTHER RESOLVED, that the above described improvement is hereby authorized and declared to be necessary in accordance with the findings of the Governing Body as set out in this resolution, and that this resolution shall take effect and be in force from and after its passage and publication once in The Manhattan Mercury. BE IT FURTHER RESOLVED, that this resolution shall be filed with the Riley County Register of Deeds Office. BE IT FURTHER RESOLVED, that the benefit district portion of the cost of the above described improvement shall be bonded for twenty (20) years.
