Retrial set in Horne case

A retrial was set Wednesday in the case of Levertis Horne, the man accused of a home invasion and shooting in October 2012.

At a hearing Wednesday afternoon in Riley County District Court, the retrial was set for Feb. 3, with jury selection on Jan. 31. The trial is expected to last five days.

Horne is accused of robbing four roommates at gunpoint at Chase Manhattan Apartments, 1400 Chase Place, on Oct. 5, 2012. One of the roommates, Chase Cargile, was shot in the torso during the incident.

Horne faces two counts of aggravated robbery, two counts of attempted aggravated robbery, aggravated burglary and aggravated battery.

Jurors deliberated for more than seven hours on Aug. 9 before Judge John Bosch declared the mistrial.
