Cole Drake hearing postponed until February

Officials at the Riley County Attorney’s office announced that the hearing to determine whether Cole Drake, the Manhattan High School student charged in the April shooting death of 14-year-old Tyler Dowling, will be prosecuted as a juvenile or an adult has been moved to February 2012.

County Attorney Barry Wilkerson said the hearing has been postponed so that the written report that will document the findings or opinion of an evaluation conducted on Cole Drake can be completed.

He said the evaluation process has taken longer than the defense, the state or the court anticipated, but that, in light of the charges and potential penalties involved, it is imperative that the defense and the state have the opportunity to review the written report in advance of the proceeding and the court have available all relevant information.

Drake’s hearing was originally scheduled for Dec. 21 and 22, but will now take place on Feb. 2 and 3, with Judge David Stutzman presiding.
