    RESOLUTION NO. 101316-41 First Published in The Manhattan Mercury on October 14, 2016. Subsequently Published on October 21, 2016. A RESOLUTION AMENDING RESOLUTION NO. 101112-47, BY ADDING SCENIC DRIVE RECONSTRUCTION TO THE LIST OF PROJECTS FUNDED BY THE EXISTING ONE-HALF OF ONE PERCENT (.5%) COUNTYWIDE RETAILERS SALES TAX WHEREAS, pursuant to K.S.A. 12-187 et seq., as amended, the governing body of Riley County, Kansas (the "County"), called an election which was held November 6, 2012 to submit to the qualified electors of the County the question of renewing a countywide retailers' sales tax in the County at the rate of one-half of one percent (.5%) (the "Sales Tax"); and WHEREAS, pursuant to and K.S.A. 19-117, the governing body of the County adopted Resolution No. 101112-47, pledging the general purposes to which any revenue received by the County from the renewed Sales Tax would be applied; and WHEREAS, renewal of the Sales Tax was approved at the November 6, 2012 election, and it shall expire December 31, 2022. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF RILEY COUNTY, KANSAS: Section 1. One category of general purposes pledged for renewed sales tax funding by Resolution No. 101112-47 was "Roadway Reconstruction." Scenic Drive reconstruction was not a project listed. Section 2. Scenic Drive reconstruction shall be described as follows: Beginning at the Manhattan City limits on Scenic Drive then commencing in a southerly direction approximately 1.3 miles to the northern KDOT right-of-way line for K-18. Section 3. K.S.A. 19-117 authorizes amendment of the foregoing pledge resolution to add Scenic Drive reconstruction to the list of projects supported by the existing countywide 1/2 cent retailers' sales tax. Section 4. Scenic Drive reconstruction is hereby added to the list of projects supported by existing countywide 1/2 cent retailers' sales tax. Section 5. This resolution shall be published once each week for two consecutive weeks in the official County newspaper and shall take effect on the 61st day after its final publication unless, within sixty (60) days of the final publication of this resolution, a petition signed by not less than five percent of the qualified electors of the County is filed with the County election officer demanding that this resolution be submitted to a vote of the electors of the County. Section 6. This resolution shall continue in effect for as long as the County receives revenue from such Sales Tax, unless it is repealed or amended in accordance with the provisions of K.S.A. 19-117.
