    RESOLUTION NO. 041615-10 Published in The Manhattan Mercury on April 24, 2015. A RESOLUTION ADOPTING AMENDMENTS TO THE RILEY COUNTY SEXUALLY ORIENTED BUSINESS CODE, AS INCORPORATEDBY RESOLUTION NO. 072904-29, ADOPTED JULY 29, 2004 THAT PROVIDES FOR THE MANAGEMENT OF SEXUALLY ORIENTED BUSINESSES WITHIN THE UNINCORPORATED AREA OF RILEY COUNTY. WHEREAS, K.S.A. 19-101a, as amended, authorizes the Board of County Commissioners ("Board") to transact all County business and perform all powers of local legislation and administration it deems appropriate; and WHEREAS, K.S.A. 12-741 et seq. provides for the enactment of planning and zoning laws and regulations by counties for the protection of public health, safety and welfare of the citizens of the county, and WHEREAS, The Vision 2025 - A Comprehensive Plan for Riley County, Kansas (Resolution No. 102209-31) adopted a functional classification of roads, which utilizes the Functional Classification Map prepared and periodically amended by the Kansas Department of Transportation - Bureau of Transportation Planning that serves as the official document for road classifications in Riley County; and WHEREAS, the Board adopted (Resolution No. 061713-44) amendments to the Riley County Zoning and Subdivision Regulations, omitting all language referring to Major/Minor Trafficways and inserting language referring to the aforementioned functional classification of roads; and WHEREAS, language within the Riley County Sexually Oriented Business Code referring to Major/Minor Trafficways has become obsolete; and WHEREAS, the Board of County Commissioners of Riley County, Kansas, has reviewed the aforesaid proposed amendments to the Riley County Sexually Oriented Business Code, and has determined that it is in the best interests of Riley County to adopt and incorporate the proposed regulation amendments; and NOW THEREFORE, BE IT RESOLVED BY the Board of County Commissioners of Riley County, Kansas: THE RILEY COUNTY SEXUALLY ORIENTED BUSINESS CODE Amend as follows: (additions are in italics; deletions are struck out) Section 16. Location of Sexually Oriented Businesses. (a) It shall be unlawful for any person to operate or cause to be operated any Sexually Oriented Business within one thousand (1000) feet of the following: (1) a church or place of worship; (2) a school; (3) a residential zoning district; (4) another Sexually Oriented Business; (5) a child care center; (6) a public park or public building; Or within five hundred (500) feet of a Major or Minor Trafficway, as designated by the County. an interstate, freeway/expressway (non-interstate), principal arterial, minor arterial or major collector, as designated by the functional classification of roads approved by the Kansas Department of Transportation (KDOT). Section 2. Adoption: Section 16 of the Riley County Sexually Oriented Business Code, as incorporated by Resolution Number 072904-29, adopted July 29, 2004, is hereby repealed. Section 3. Jurisdiction: From the effective date of this resolution, the Riley County Sexually Oriented Business Code, as amended herein, shall govern land located within the unincorporated territory of Riley County subject to these regulations. Section 4. Official Copies: At least one copy of the Riley County Sexually Oriented Business Code shall be marked or stamped "official copy as incorporated by Resolution No. 041615-______" and to which there shall be attached a copy of this resolution. Such official copy shall be filed and maintained in the office of the Riley County Clerk, open for public inspection and available to the public at all reasonable business hours, provided that such official copy may not be removed from the County Office Building. Copies of the official publication shall be furnished without charge to the courts and all administrative agencies charged with enforcement of such publication. Section 5. Effective Date: This resolution shall take effect and be in force from and after its publication in the official county newspaper.
